Der Gegenstand dieser Schenkungsvereinbarung ist <strong>unentgeltliche \u00dcbertragung des Eigentums an einer Wohneinheit, die auf der Grundlage des Zivilgesetzbuches definiert wurde, d. h. nach dem 1.1.2014 definiert wurde<\/strong> (seznateln\u00e9 tak\u00e9 z\u00a0v\u00fdpisu z\u00a0katastru nemovitost\u00ed). Opr\u00e1vn\u011bn\u00fd ze slu\u017eebnosti (d\u00e1rce), vzhledem k\u00a0v\u00fd\u0161e uveden\u00e9mu, nen\u00ed povinen za z\u0159\u00edzen\u00ed sjednan\u00e9 slu\u017eebnosti hradit povinn\u00e9mu ze slu\u017eebnosti (obdarovan\u00e9mu) pen\u011b\u017en\u00ed n\u00e1hradu. Vzhledem ke smluvn\u00ed volnosti si mohou d\u00e1rce a obdarovan\u00fd upravit tato ujedn\u00e1n\u00ed dle libosti a dohodnout se na konkr\u00e9tn\u00ed \u010d\u00e1stce za z\u0159\u00edzen\u00ed slu\u017eebnosti, \u010di na pravideln\u00fdch nap\u0159. m\u011bs\u00ed\u010dn\u00edch \u010d\u00e1stk\u00e1ch. Spole\u010dn\u011b s t\u00edmto vzorem z\u00edsk\u00e1v\u00e1te praktick\u00fd <strong>eine Beschreibung, die Sie beim Ausf\u00fcllen der Vorlage und dem anschlie\u00dfenden Verfahren zur Eintragung des Rechts im Grundbuch unterst\u00fctzt<\/strong>. Dar\u00fcber hinaus gibt Ihnen die Beschreibung auch einen vereinfachten \u00dcberblick \u00fcber die allgemeinen gesetzlichen Regelungen des Instituts der Schenkung und die Definition von Wohneinheiten.<\/p>\n<p>Die Schenkungsvereinbarung lautet <strong>unentgeltliche Rechtsverfolgung<\/strong>durch die der Schenker das Eigentum an der Sache auf den Beschenkten \u00fcbertr\u00e4gt oder sich verpflichtet, das Eigentum in Zukunft zu \u00fcbertragen, nimmt der Beschenkte die Schenkung an. Wird das Eigentum an einer unbeweglichen Sache \u00fcbertragen, muss die unbewegliche Sache genau bezeichnet werden. Au\u00dferdem m\u00fcssen die Absicht, das Eigentum an dem geschenkten Gegenstand zu \u00fcbertragen, und die Unentgeltlichkeit einer solchen \u00dcbertragung ausdr\u00fccklich zum Ausdruck gebracht werden.<\/p>\n<p>Grunddienstbarkeiten sind eine von zwei Arten von Dienstbarkeiten. Neben den Grunddienstbarkeiten kennt das Gesetz auch die Reallast. Eine Grunddienstbarkeit ist <strong>die Verpflichtung des Eigent\u00fcmers der unbeweglichen Sache, die Aus\u00fcbung der Rechte des Beg\u00fcnstigten der Dienstbarkeit zu dulden<\/strong>. Wir unterscheiden zwischen zwei Kategorien von Dienstbarkeiten, n\u00e4mlich Grunddienstbarkeiten, die sich auf ein bestimmtes Grundst\u00fcck beziehen, und pers\u00f6nlichen Dienstbarkeiten, die an eine bestimmte Person gebunden sind. Wenn eine Grunddienstbarkeit f\u00fcr eine Wohnung begr\u00fcndet wird, ist sie <strong>der Beg\u00fcnstigte der Grunddienstbarkeit ist berechtigt, das Grundst\u00fcck, auf das sich die Grunddienstbarkeit bezieht, zu nutzen<\/strong>.
